Agreement to Terms of Business When purchasing a policy from WeGuardMotors, both you and WeGuardMotors acknowledge the acceptance of these Terms of Business. In addition to the contract you establish with the Insurer, a separate contract with WeGuardMotors Limited for insurance policy arrangement and administration is formed. This agreement pertains to the specific insurance intermediary services that WeGuardMotors directly provides to you.

Before purchasing a policy, we encourage you to carefully read the information within these Terms of Business to determine if our services align with your needs.

1. Regulatory Oversight

WeGuardMotors Ltd is authorized and regulated by the Financial Conduct Authority (FCA), which is the independent regulatory body overseeing financial services, including insurance. Our FCA registration number can be found on https://register.fca.org.uk/ or by contacting the FCA at 0800 111 6768. Our permitted business includes arranging, assisting in the administration of, and executing contracts of insurance.

2. Our Service Offering

At WeGuardMotors, we provide access to a variety of short-term motor insurance policies with durations less than 1 month. Our services encompass presenting suitable products, confirming prices, facilitating setup, administration, and collecting insurance payments. Additionally, we collaborate with our specialized claims management partner to guide you through the claims process in the unfortunate event of an accident or incident involving your vehicle.

We do not provide advice or personal recommendations. We assist in making informed choices by asking relevant questions to narrow down cover options and providing information related to your insurance needs. After receiving a quotation, it’s your decision on how to proceed. We are available to address questions but do not offer advisory services.

3. Acting on Your Behalf

As an Insurance Intermediary, we match customers with suitable insurance products. During our engagement, we act as your agent or the insurer’s agent as necessary.

We act on your behalf during the preparatory stages of setting up your insurance policy.

We represent you when managing the insurance contract, including claim notifications. Our claims handling team assists you in understanding the claims process and provides step-by-step guidance.

For presenting insurer products and aiding policy administration, we act as the insurer’s agent. We source optimal prices and present you with documentation for informed decision-making. Any instances of acting on behalf of other parties will be communicated to you to ensure transparency in potential conflicts of interest.

4. Offered Products

WeGuardMotors offers policies from a diverse group of insurers providing the required coverage types. We compare these policies in terms of coverage and price to offer an appropriate quotation. Our aim is to provide you with the generally most cost-effective quotation based on the provided information.

While we diligently assess the financial stability of our insurer partners, we cannot be held liable if an insurer ceases trading.

5. Cost Structure

The overall price includes the insurer premium, a WeGuardMotors Fee, and any optional extras or introducer fees if applicable.

Insurer Premium: The insurer premium includes underwriting costs, insurer charges, Insurance Premium Tax, and any commission we receive from the insurer. Our commission varies depending on the insurer arrangement, including instances with zero commission.

Add-ons: Optional extras such as Breakdown Cover (by AA), Excess Reduction (by Coplus), and Legal Expenses Insurance (by Coral Insurance) are available. When you choose these extras, WeGuardMotors receives a commission from the product provider(s). These costs are integrated into the total price presented upon including the extras.

WeGuardMotors Fee: The WeGuardMotors Fee covers our preparatory work, arranging, administering, and executing the insurance contract. This fee reflects our efforts in placing your business, carrying out necessary checks, customer service, and claims management. We provide the WeGuardMotors Fee amount upfront before purchase.

For arrangements and administration of your insurance, our fee adheres to the following maximums:

Temporary Car Insurance: £130 Temporary Van Insurance: £130 Temporary Bike Insurance: £130 Temporary Learner Insurance: £130 Impounded Vehicle Insurance: £200

Introducer Fee: If you purchase through a partner, an introducer fee might apply.

Additional Fees: We may also receive fees from our claims management partner and engage in profit share agreements with insurers.

6. Handling of Funds

We act as the insurer’s agent for collecting premium and any refunds. Premiums are deemed received by the insurer upon entering our insurer trust account. Any interest or investment returns on these funds are retained by WeGuardMotors.

7. Duty to Disclose Information

When entering into a non-business insurance contract, you have a legal obligation to provide accurate information to insurers. Misrepresentation can result in claim denials. Deliberate, reckless, or careless misinformation may lead to claim non-payment.

8. Changes, Cancellations, and Refunds

For policies under 30 days, changes or additions are not possible, and no refunds are applicable upon cancellation due to the short-term nature. This adheres to Financial Conduct Authority regulations.

9. Claims Handling

10. Addressing Unhappiness with Service

While we strive for exceptional service, if you need to raise concerns, please contact us in writing, by email, or phone. You can also involve the Financial Ombudsman Service if necessary.

11. Financial Services Compensation Scheme (FSCS)

WeGuardMotors’s obligations are covered by the FSCS. Compensation may be available if we fail to fulfill obligations due to certain circumstances. Details are available on the FSCS website or by calling 0800 678 1100.

12. Privacy & Confidentiality

We collect necessary personal information for insurer understanding and premium calculation. All collected data is treated as private and confidential. Our compliance with the Data Protection Act 2018 ensures your data’s security. For data subject rights, refer to our Privacy Notice.

13. Conflict of Interest

We manage conflicts of interest by monitoring outcomes. Any potential conflicts are communicated to you with consent obtained.

14. Insurer Schedule and Certificate

Your insurer policy schedule and certificate are issued upon full premium payment. These will be sent via email, with postal copies available upon request.

15. Information Exchange Registers

Insurers share data with claims and underwriting registers to prevent fraudulent claims. Vehicle details are also added to the Motor Insurance Database for police access to confirm insurance.

16. Applicable Law

These Terms of Business are subject to English Law and the jurisdiction of English Courts.
